While it may be inconvenient to go out of your way to get the best attorney, birth injury cases are so complex and costly to pursue that you need to select an attorney who is equipped to develop your case properly. 

To find the right attorney, you need one who has demonstrated expertise, someone to whom you can relate, and who will make themselves available to you throughout this process that may take years to complete.

How to find the right attorney to meet your needs:

  • Search the internet for an attorney having special expertise, resources, and interest in litigating Erb's Palsy cases.
  • Schedule a face-to-face meeting and ask:
    • Do they have a nurse or physician on staff?
      • Most serious contenders have a medical professional on staff.
    • Have they handled Erb's cases before?
      • You do not want them to learn how to handle this kind of case, on your case.
    • Are they Board Certified in Medical Malpractice by a major attorney-certifying agency, such as A.B.P.L.A.(American Board of Professional Liability Attorneys)? 
      • Board Certification proves that the attorney has been tested and is recognized as qualified in his field.
    • What is the concentration of the practice?
      • General practitioners tend not to have the resources, contacts, and systems in place to develop a complex case as a birth injury case.
      • A specialized case should have an attorney who specializes in that area.
    • How many attorneys are in the practice?
      • Sole practitioners and small law firms are more likely to give you personal attention, than big firms, where you tend to be "just a number.'
    • How many birth injury cases have they done?
    • What jury awards or settlements have they obtained?
      • This information is often posted on the law office website.
    • Is the initial interview free of charge?
      • You should have no trouble getting a free consultation even from the best malpractice lawyers.
    • What is the fee for service?
      • This type of case is typically done on a contingency fee (no fee unless successful), typically a percentage of the recovery ranging from 25-40% that varies from state-to-state.
    • How quickly do they return your calls?
    • Does the attorney or a medical professional give you and your case their attention?
  • Inquire about the reputation of the firm and attorneys with whom you are considering working.
    • Even in big cities, medical malpractice professionals are a small and close-knit group and tend to know each other, and generally will tell you if you inquire, whether you are dealing with a reputable and experienced group.

    You can choose any lawyer you want, of course. But choosing an attorney on a complicated case based on geographic convenience is foolish. Why not just go to the nearest storefront attorney who dabbles in wills, real estate closings, divorces, traffic tickets, auto accidents, and will take on an occasional malpractice case here or there, if one happens to walk in?

    You can be certain that the doctor, hospital, or negligent medical professional, who injured your baby will hire a defense attorney whose entire professional focus is on defending people who have been charged with medical negligence.   You also need to hire an attorney who has the same focus and expertise.  You need a Plaintiff's attorney, who specializes in medical malpractice.   The serious players in medical malpractice are in New York City, not in the outlying towns.
